GOVERNMENT SCHEMES AND LEGAL PROVISIONS FOR HOMELESS PEOPLE

Both national and international laws help homeless people in solving housing problems and human rights problems of homeless people. At the international level, the right to housing of homeless people is enshrined in the economic, social and cultural treaties of homeless people. At the national level, Indian law, especially Article 21, protects the right to life and personal liberty. Under this fundamental right, the Universal Declaration of Human Rights recognizes human dignity and includes the right to a dignified life including housing. The right to dignified housing for homeless people is also included in this. The decision of the Indian Supreme Court is also important in this regard. The following international laws are important for the protection of the rights of homeless people: 1. Universal Declaration of Human Rights 2. International Treaty on Economic, Social and Cultural Rights. The right to dignity including housing of these homeless people has been recognized in this treaty and various states have been encouraged to take the required and positive steps in relation to these homeless people.

राष्ट्रीय और अंतरराष्ट्रीय दोनों कानून आवास विहीन व्यक्तियों को आवास संबंधी समस्याओं तथा आवास विहीन व्यक्तियों की मानव अधिकार संबंधी समस्याओं में सहयोग प्रदान करते हैं अंतरराष्ट्रीय स्तर पर आवास विहीन व्यक्तियों का आवास संबंधी अधिकार आवास विहीन व्यक्तियों की आर्थिक सामाजिक तथा सांस्कृतिक संधियों में निहित है। राष्ट्रीय स्तर पर भारतीय कानून विशेष रूप से अनुच्छेद 21 जीवन और व्यक्तिगत स्वतंत्रता के अधिकार की रक्षा करता है इस मूल अधिकार के अंतर्गत मानवीय अधिकारों के सार्वजनिक घोषणा पत्र में मानव गरिमा को मान्यता दी गई है तथा आवास सहित सम्मानजनक जीवन का अधिकार भी इसमें शामिल है आवास विहीन व्यक्तियों के लिए सम्मानजनक आवास का अधिकार भी शामिल है इस संबंध में भारतीय सर्वाेच्च न्यायालय का निर्णय भी महत्वपूर्ण है आवास विहीन व्यक्तियों के अधिकारों की सुरक्षा के लिए निम्न अंतरराष्ट्रीय कानून महत्वपूर्ण हैं 1.मानवीय अधिकारों का सार्वजनिक घोषणा पत्र 2.आर्थिक सामाजिक और सांस्कृतिक अधिकारों पर अंतरराष्ट्रीय संधि आवास विहीन इन व्यक्तियों के आवास सहित उनके सम्मानजनक अधिकार को इस संधि में मान्यता प्रदान की गई है तथा विभिन्न राज्यों से आवास विहीन में इन व्यक्तियों के संबंध में अपेक्षित और सकारात्मक कदम उठाने को प्रेरित किया गया है।
