DEPICTION OF LEGAL REALITY IN INDIAN JUDICIAL SYSTEM IN HINDI FICTION

Abstract [English]

Pawan Chaudhary Manmuji, an excellent writer of Hindi literature on law, is an experimental writer. He has drawn a realistic picture of the image of Indian courts in his works. On hearing the word court, Kachheri, a new form of exploitation appears. The writer has given a heart-touching description of this in his writings- "Court or Kachheri - as soon as this word is seen or heard anywhere, many images appear before the eyes, many men of young and old age wearing black coats, some women, many clients sitting inside the courts, standing in the verandahs, criminals, some policemen wearing khaki uniforms, court peons, Ahlmad, peon etc. Thus, the above-mentioned creatures are seen in the court. Here and there in the court, only the following memorized, heard-of voices are heard- "Many dialogues start to come to the ears- State vs Vinod Kumar; Radhakrishna vs Kantarani; Balwant Rai vs DDA; your name, your father's name; have your witnesses come? Call your lawyer sahab; Sir, this time I could not summon the witnesses, please give me the date, next time I will definitely send the summons etc." Thus, the description of these legal tricks and its shortcomings is heard with sorrow on the tongue of the people everywhere- "Some people are heard making various kinds of comments on law, legal system, politics, society- sweet, salty, bitter, nauseating."1 Hence, sometimes one feels nauseated due to this judicial plight.

कानून विषयक हिन्दी साहित्य के उत्कृष्ट रचनाकार पवन चैधरी मनमौजी एक प्रयोगधर्मी लेखक हैं। भारतीय न्यायालयों की छवि का यथार्थ चित्र उन्होंने अपनी रचनाओं में खींचा है। कोर्ट, कचहरी नाम सुनते ही शोषण का नया रूप दिखाई देता है। जिसका हृदयस्पर्शी निरूपण लेखक ने अपने लेखन में किया है-‘‘कोर्ट अथवा कचहरी-कहीं यह एक शब्द दिखायी अथवा सुनायी पड़ते ही, अनायास अनेक चित्र आँखों के सामने प्रगट हो जाते हैं, काला कोट पहने छोटी-बड़ी आयु के अनेक पुरुष, कुछ महिलाएँ, अदालतों के अंदर बैठे, बरामदों में खड़े अनेक मुवक्किल, मुजरिम, खाकी वर्दी धारण किए कुछ पुलिसकर्मी, अदालतों के पेशकार, अहलमद, चपरासी इत्यादि। इस प्रकार कोर्ट में उपरोक्त प्राणी दिखाई दे जाते हैं।’’ कोर्ट के इधर-उधर मात्र रटी-रटाई, सुनी-सुनाई निम्न आवाजें ही सुनाई देती हैं-‘‘कई संवाद कानों में सुनाई देने लगते हैं-राज्य बनाम विनोदकुमार; राधाकृष्ण बनाम कान्तारानी; बलवंत राय बनाम डी.डी.ए.; आपका नाम, आपके पिता का नाम; आपके गवाह आए हैं? आप अपने वकील साहेब को बुलवाइये; हुजूर, इस बार मैं गवाह समन नहीं करवा सका, तारीख दे दीजिए, अगली बार जरूर समन भेज दूँगा आदि।’’ इस प्रकार इन कानूनी दांव-पेंचों, उसकी कमियों का वर्णन लोगों की जुबान पर दुख के साथ यत्र-तत्र-सर्वत्र सुनने को मिल जाता है-‘‘कुछ लोग कानून, कानून प्रणाली, राजनीति, समाज पर विभिन्न प्रकार की टिप्पणियाँ करते सुनायी पड़ते हैं-मीठी, नमकीन, कड़वी, जी मिचलाने वाली।’’1 अतः इस न्यायिक दुर्दशा से कभी-कभी तो जी मिचलाने लगता है।
